StraySafe Terms of Service

Please read these Terms of Service ("Terms") carefully before using the StraySafe mobile application ("Service", "App") operated by StraySafe ("we", "us", or "our").

1. Acceptance of Terms

By downloading, accessing, or using StraySafe, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use our Service.

You must be at least 18 years old to use StraySafe. By using our Service, you represent and warrant that you are at least 18 years of age.

2. Description of Service

StraySafe is a mobile application designed to help users report lost pets and track stray animals, connect with animal shelters, and participate in community discussions about animal welfare. Our Service includes:

StraySafe is currently designed and optimized for users in Hong Kong SAR, China. While the app may be accessible in other regions, the following features are specifically tailored for Hong Kong:

Users outside Hong Kong may experience limited functionality or relevance of certain features. We do not guarantee the accuracy or availability of services for users in other jurisdictions.

3. User Accounts and Registration

3.1 Account Creation

To access certain features of StraySafe, you must create an account by providing accurate, current, and complete information. You may create an account using email/password, Google Sign-In, or Apple Sign-In. You are responsible for maintaining the confidentiality of your account credentials.

When using Apple Sign-In, data linking is required to access core app functionalities. You will be presented with a consent modal explaining this requirement before proceeding. You may choose to use Apple's "Hide My Email" feature to keep your email address private while still allowing necessary data linking for service functionality.

4. User-Generated Content

4.1 Content You Provide

StraySafe allows users to upload, post, and share content including text, images, reports, and forum posts ("User Content"). You retain ownership of your User Content, but you grant us certain rights as described below.

By uploading or posting User Content to StraySafe, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, modify, adapt, publish, and distribute your User Content solely for the purpose of:

We reserve the right to review, moderate, edit, or remove any User Content at our sole discretion, including content that violates these Terms or our Community Guidelines. We are not obligated to monitor User Content but may do so.

4.5 Reporting Inappropriate Content

Users can report inappropriate content through our in-app reporting system. We will investigate reports and take appropriate action, which may include content removal and account suspension.

5. Feedback and Suggestions

5.1 Feedback License

By providing feedback, suggestions, ideas, or other input to StraySafe ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free, and fully sublicensable license to use, modify, reproduce, distribute, and incorporate such Feedback into our services without any compensation, attribution, or obligation to you.

5.2 No Obligation

We have no obligation to use your Feedback, and you acknowledge that we may develop similar features independently.

6. Premium Features and In-App Purchases

6.1 Premium Purchase

StraySafe offers premium features available through a one-time in-app purchase, including ad-free experience. Premium features are subject to the terms of the applicable app store (Apple App Store or Google Play Store).

Premium status is permanently linked to both your Apple ID (for purchase verification) and your StraySafe account (for feature access). Premium benefits are only accessible when signed into the StraySafe account associated with the original purchase. Premium status cannot be transferred between different StraySafe accounts, but can be restored on new devices using the same Apple ID and StraySafe account combination.

7. Privacy and Data Protection

7.1 Privacy Policy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

7.2 PDPO Compliance

For users in Hong Kong, we comply with the Personal Data (Privacy) Ordinance (PDPO). You have rights regarding your personal data, including the right to access, correct, and delete your information.

StraySafe uses location services to provide location-based features. Location permission is requested only when you first use location features (user-initiated). You can control location permissions through:

9.1 Our Rights

StraySafe and its original content, features, and functionality are owned by us and are protected by copyright and other applicable intellectual property laws. We retain all rights, title, and interest in and to the Service, including but not limited to:

The StraySafe name, logo, and other identifying marks are our proprietary identifiers. You may not use the StraySafe name, logo, or other branding elements without our prior written consent. This includes but is not limited to creating derivative works, using our name in domain names, or suggesting affiliation or endorsement.

9.3 Third-Party Content

Our Service may contain content owned by third parties, including but not limited to images, text, software libraries, and other materials. Such third-party content is protected by copyright and other intellectual property laws and remains the property of their respective owners.

10. Community Guidelines

10.1 Respectful Behavior

Users must treat others with respect and courtesy. Harassment, bullying, or discriminatory behavior is not tolerated.

10.2 Animal Welfare Focus

Content should be relevant to animal welfare and the purpose of StraySafe. Off-topic or inappropriate content may be removed.

10.3 Accurate Reporting

When reporting stray animals, provide accurate location and description information to help the community effectively.

11. Disclaimers and Limitations

11.1 Service Availability

We strive to maintain service availability but cannot guarantee uninterrupted access. The Service is provided "as is" and "as available."

11.2 User Content Disclaimer

We do not endorse or verify User Content. Users are responsible for evaluating the accuracy and reliability of information shared by other users.

11.3 Animal Safety

While StraySafe aims to help stray animals, we cannot guarantee the safety or welfare of any animals. Users should exercise caution and follow local laws when interacting with stray animals.

12. Limitation of Liability

To the maximum extent permitted by law, StraySafe shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses resulting from your use of the Service.

Our total liability for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or HK$100, whichever is greater.

You agree to indemnify and hold harmless StraySafe and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

14.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature in the app.

14.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or our business.

14.3 Effect of Termination

Upon termination, your right to use the Service will cease immediately. We may delete your account and User Content, subject to applicable law and our Privacy Policy. Premium purchases are non-refundable upon account termination.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms are governed by the laws of Hong Kong SAR, without regard to conflict of law principles.

15.2 Dispute Resolution

Any disputes arising from these Terms or your use of StraySafe shall be resolved through binding arbitration in Hong Kong, except where prohibited by law.

We reserve the right to modify these Terms at any time. We will notify users of changes by:

Changes become effective immediately upon posting. Your continued use of StraySafe after changes are posted constitutes acceptance of the new Terms.

17. Apple App Store Specific Terms

For the purposes of this section, "we" refers to Cheng Chun Hei, the developer and publisher of StraySafe.

17.1 Acknowledgement

You and we acknowledge that these Terms are concluded between you and us only, and not with Apple Inc. ("Apple"). We, not Apple, are solely responsible for the StraySafe application and its content. These Terms do not provide for usage rules that conflict with the Apple Media Services Terms and Conditions.

17.2 Scope of License

The license granted to you for StraySafe is limited to a non-transferable license to use the application on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. The application may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.

17.3 Maintenance and Support

We are solely responsible for providing maintenance and support services for the application. You acknowledge that Apple has no obligation to furnish any maintenance and support services.

17.4 Warranty

We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation, and any other claims, losses, liabilities, damages, costs, or expenses will be our sole responsibility.

17.5 Product Claims

You and we acknowledge that we, not Apple, are responsible for addressing any claims relating to the application or your possession and use of it, including but not limited to: (i) product liability claims; (ii) any claim that the application fails to conform to legal or regulatory requirements; and (iii) claims arising under consumer protection, privacy, or similar legislation.

17.6 Intellectual Property Rights

You and we acknowledge that, in the event of any third-party claim that the application or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

17.7 Legal Compliance

You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

17.8 Third Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using StraySafe. If you use any VoIP features, you must not violate your wireless data service agreement when using the application.

17.9 Third Party Beneficiary

You and we acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect.
